eLand Registration in Sri Lanka; A pathway for the mother of all scams? By Raj Gonsalkorale   Glory of technology is such that no one will object to introducing technology to land registries.  But will the land owners have their rights protected? We only admire the glory of technology as a duck gliding on water without seeing the paddling underneath. Land owners need to be alerted that their ownership rights may not be available in the land registry By Raj Gonsalkorale eLand registration will soon be operating the land registration system to secure ownership. However, it can be a source of ownership insecurity, without consumer protection laws. The risk involved in the absence of consumer protection laws to protect owners was demonstrated in USA, when New York News Paper prepared a forged deed to transfer the Empire State Building.   The forged document was registered in 90 minutes, the land registry had no laws to protect owners, therefore did ...

Deforestation in Sinharaja and elsewhere; It is time the President took action – By Raj Gonsalkorale   Sinharaja Forest Reserve is a forest reserve and a biodiversity hotspot in Sri Lanka. It is of international significance and has been designated a Biosphere Reserve and World Heritage Site by UNESCO. According to International Union for Conservation of Nature (IUCN), Sinharaja is the country’s last viable area of primary tropical rainforest. More than 60% of the trees are endemic and many of them are considered rare. 50% of Sri Lankan’s endemics species of animals (especially butterfly, amphibians, birds, snakes and fish species). It is home to 95% endemic birds -Wikipedia By Raj Gonsalkorale The Sinharaja forest is the country’s most priceless jewel that belongs to the future generations to come. Any person or entity that has destroyed this jewel has committed a crime where punishment is useless as this forest and its bio diversity can never be regenerated by punishing anyone after the event. ...

Oprah’s opera, the Harry and Meghan show; An anachronism draws millions of TV viewers – by Raj Gonsalkorale Oprah Winfrey’s interview with Meghan and Harry pulls in 17.1 million viewers on CBS. Prince Harry and Meghan, the Duke and Duchess of Sussex, speak with Oprah Winfrey for a two-hour telecast on CBS Prince Harry, the Duke of Sussex and Meghan the Duchess of Sussex are troubled individuals. One cannot but feel for them in their hour of reflection, tinged with more than a share of bitterness, anger, anguish and disappointment.  The Royal household in the UK is an anachronism, more to the rest of the world perhaps than to the UK itself. The popularity of Queen Elizabeth and generally the lustre that accompanies the Royalty, but, not forgetting the scandals that paradoxically humanises them, is a big draw to many in the UK, as well as to tourists who go there. The ongoing Royal opera earns plenty of ...

Death of a Colossus – Sunil de Silva – by Raj Gonsalkorale Sunil de Silva Sunil de Silva, a lawyer of immense repute who strode the legal halls of fame in Sri Lanka and Australia passed way peacefully in Gosford, New South Wales on 28th February 2021. He was 80 years old. Sunil was well known amongst those living in New South Wales, Australia, more for his affability, wit, instant rejoinders, and his ongoing engagement with the Sri Lankan community.  He was colosus, not just in his intellect, but his demeanor! A larger than life figure who one could never miss in a crowd! Despite all this, he was a kind and soft person within and would melt emotionally when seeing unfortunate circumstances befalling others. He was a lover of drama and acted in many stage productions and recently, took to the cinema as well. His many roles in stage productions ...

Sri Lankan infection rate heading towards 100,000; Quo Vadis COVID 19?  By Raj Gonsalkorale   The Latin phrase Quo Vadis denotes an episode from the life of Saint Peter, as told in the New Testament Apocrypha and the ‘Golden Legend’. Peter fled from Rome during the persecution of Christians under the emperor Nero; as he was travelling along the Appian Way he met Christ in a vision. Astonished, he asked ‘Domine quo vadis?’ (‘Lord, where are you going?’). Christ replied that he was going to Rome to be crucified a second time. Peter then realised that his departure from the city was cowardly and returned to face whatever persecutions might befall him.  www.nationalgallery.org.uk The phrase “Quo Vadis” or where are you going or in Sinhala “Koheda Yanne?” seems to have similarities to the COVID pandemic in Sri Lanka. Does the country and those governing it know which direction it is ...

Who is a Buddhist – by Raj Gonsalkorale A man is not called wise because he talks and talks again; but is he peaceful, loving and fearless then he is in truth called wise. Even as a solid rock is unshaken by the wind, so are the wise unshaken by praise or blame – Buddha By Raj Gonsalkorale It appears that labelling oneself as a Sinhala Buddhist and the country as a Sinhala Buddhist Nation is the national ethos while saying or implying that all others in the country are accommodated in the island because of the generosity of this national ethos. The purpose in writing this article is with the hope that it will generate some amount of contemplation and discussion as to who a Sinhalese is and who a Buddhist is, and perhaps who they should be. A question worth pondering is whether an outer garment matters more ...

Legitimate caveats under threat in Sri Lanka?-By Raj Gonsalkorale There is speculation that caveats, the one thing that protects genuine private land owners from fraudsters who manage to sell their land with bogus land titles, and protects genuine third parties from exploitation by land owners, is under threat and that legislation is being drawn to change land registration laws that permit caveats on land titles. This matter is something that may concern many Sri Lankans living overseas who own land in Sri Lanka and have registered legitimate caveats.  It is unclear whether lawyers and notaries were consulted on this development. If not, it may seem that they are gradually being sidelined on law reform in Sri Lanka. If this indeed is an evolving trend, lawyers have to take some of the blame for this as they do not seem to have been engaged in furthering law reform   in the country ...

Opportunities ahead after the mighty destroyer COVID 19 leaves us – By Raj Gonsalkorale Karl Marx had predicted that like previous socio-economic systems, capitalism produced internal tensions which would lead to its self-destruction and replacement by a new system known as socialism. While it’s too early to tell whether the destruction caused by the coronavirus is philosophically what Marx predicted, the after effect of it at least seems to offer opportunities for the world to seize upon and build a new house where there is much less inequality amongst its inhabitants. Socialism or by any other name, a governance system that takes the world towards a social organization where the ownership of the means of production, distribution, and exchange is more broad based and where there is greater ownership by the community as a whole, might be on the cards. Pandemics are nothing new and history records several that have killed many people, devastated ...
