The historic city of Kandy, the cultural heart of Sri Lanka, is set to receive a significant boost in the preservation of its most iconic event. In a landmark decision, the Sri Lankan Cabinet of Ministers has officially approved a proposal to establish a comprehensive intellectual property (IP) protection framework for the world-renowned Kandy Esala Perahera. This move, spearheaded by a joint initiative with the World Intellectual Property Organization (WIPO), aims to safeguard the historical, cultural, and religious identity of the “Dalada Perahera” for generations to come.

The Kandy Esala Perahera is not merely a festival; it is a profound expression of Sri Lanka’s spiritual heritage and artistic excellence. For centuries, this grand procession has paraded through the streets of Kandy, honouring the Sacred Tooth Relic of the Buddha. However, in the modern era of rapid digital dissemination and global commercialisation, the need to protect the traditional knowledge and cultural expressions associated with the pageant has become instrumental.

A Decisive Step for Cultural Preservation

The proposal for this protection was brought forward by the Minister of Trade, Commerce, Food Security, and Cooperative Development, and was jointly chaired by the Minister of Buddha Sasana, Religious, and Cultural Affairs. The Cabinet has granted approval to reappoint a specialised committee comprising key stakeholders to prepare a detailed project proposal. This committee will be tasked with outlining how to best utilise intellectual property rights to protect the unique facets of the Perahera.

According to Cabinet spokesperson Minister Dr. Nalinda Jayatissa, the primary focus of this initiative is to ensure that the pageant’s historical and cultural identity remains untainted by unauthorised commercial exploitation. By securing trademarks, brand names, and publication rights, the organisers can maintain control over how the Perahera is represented and monetised globally, ensuring that any benefits are channelled back into the preservation of the tradition itself.

The Role of WIPO and Festival Tourism

The initiative is being developed under a specific WIPO project titled “Promoting Festival Tourism Development through Intellectual Property”. This global programme is designed to assist cultural festival organisers in leveraging IP rights to foster sustainable tourism development while maintaining strict respect for local traditions and heritage.

The Kandy Esala Perahera has been identified as a prime candidate for this international project. As one of Asia’s most spectacular cultural events, it attracts hundreds of thousands of visitors, including many members of the Global Sri Lankan community and international tourists. By integrating an IP framework, the authorities aim to enhance the festival’s tourism potential in a way that is both economically viable and culturally respectful. This balance is crucial for preserving the sanctity of the event, which remains first and foremost a religious tribute.

What Does Intellectual Property Protection Entail?

In the context of a centuries-old cultural procession, intellectual property protection might seem like a modern legal intrusion. However, it is an essential tool for protecting “traditional cultural expressions.” The proposed framework will focus on several key areas:

  1. Trademarks and Branding: The name “Kandy Esala Perahera” and associated logos or brand identifiers will be legally protected. This prevents third-party organisations from using the festival’s identity to sell products or services without authorisation or in a manner that degrades the event’s prestige.
  2. Copyright and Publication Rights: This covers the creative works associated with the pageant, including official recordings, documentation, and specific choreographic or artistic performances. It ensures that the intellectual efforts of the artisans, dancers, and drummers are recognised and protected.
  3. Preventing Misappropriation: Perhaps most importantly, the framework seeks to prevent the unauthorised commercial exploitation of sacred symbols and traditional motifs. This ensures that the cultural heritage of the Sri Lankan people is not reduced to a mere commodity for global markets without due respect and benefit to the source community.

Safeguarding the Artisans and Performers

The Kandy Esala Perahera is a living museum of Sri Lankan craftsmanship. From the intricate silverwork on the dancers’ regalia to the hand-woven velvet robes of the elephants, the festival represents the pinnacle of traditional arts. The artisans who spend months preparing for these ten days of devotion are the custodians of ancient techniques passed down through lineages.

By formalising intellectual property rights, the government aims to provide a structured environment where these artisans and performers can be better supported. When the “brand” of the Perahera is protected, it creates opportunities for official merchandise and high-quality documentation that can provide a sustainable income for the traditional families involved in the pageant’s organisation. This is particularly vital for Sri Lankans abroad who wish to support authentic cultural products and initiatives.

The Global Perspective: Connecting with Sri Lankans Abroad

For the Global Sri Lankan community, the Kandy Esala Perahera is a powerful symbol of their heritage and national identity. Whether living in Australia, the UK, or Canada, many Sri Lankan expatriates tune in to watch the live broadcasts or plan their visits to the motherland to coincide with the festivities.

The move to protect the IP rights of the Perahera ensures that the content they consume, whether through videos, photographs, or news articles, is of the highest quality and remains authentic. It also assures the community that their heritage is being actively guarded against misappropriation on the international stage. eLanka, as a primary bridge for Sri Lankans living globally, celebrates such initiatives that promote and protect the positive stories of our rich history.

Future Outlook for Sri Lanka’s Cultural Heritage

The Cabinet’s approval is a foundational step. The reappointed committee will now work closely with WIPO experts to draft the final proposal, which will serve as a blueprint for other cultural festivals in Sri Lanka. This approach reflects a modern understanding of heritage management, where the preservation of the past is harmonised with the legal and economic realities of the present.

As Sri Lanka continues to navigate its path toward economic recovery and cultural resurgence, protecting its unique “intellectual capital” becomes a priority. The Kandy Esala Perahera stands as a testament to the resilience and artistry of the Sri Lankan people. Through this new legal framework, its drums will continue to echo, and its torches will continue to burn brightly, protected by the very laws that govern the modern world.
